Journal tomhudson's Journal: Stupid Landlord Trix - Court Date is Set, and More LOLs 3

For those of you who have been paying attention, this case celebrated its second birthday a while back, which is quite something else when the vast majority of these cases are resolved in months, not years.

For those who are new to this series - my old landlord rented me a house that turned out to be a total disaster. He bought it to do a quick "hide the defects and flip it real fast and make a wad of money", but that didn't work out so well ... and he misrepresented it when I rented it. Can you spell "F-R-A-U-D"? I knew you could :-)

So, since then, it basically fell apart (ceiling falling in, mice coming in from the holes in the foundation, COLD in the winter, hot water tank went BANG, all sorts of "fun stuff" ... and him being stuck to the wall, financially, tried to squeeze me, first by trying to renege on the lease terms ($1070/month) by demanding more, then by falsely trying to claim that I hadn't sent my refusal to renew in time and owed an additional $16,200.00.

Lots of threats and one stupid bribe attempt later (I finally had to call the police - I don't take bribes, unless it's chocolate :-), I finally called the city in to inspect. He was ordered to complete the repairs within 10 days.

Of course, he didn't do anything.

I got confirmation from the court that I could move out, and we've been fighting in court ever since.

Some new stuff:

  1. He rented it out to someone else 4 months after I moved out. They couldn't move in in November of last year because he hadn't yet done the city-ordered repairs (the same repairs that the city gave him 10 days to do back in May). There's a court judgment awarding the tenant money for this. They also sued for $$$ because of the lack of insulation, etc., same as I was complaining about.
  2. The property was foreclosed on by the bank. In the latest move, it's no longer listed for sale by the agent - I guess he finally gave up on it. Having to list all the defects kind of makes it a hard sell in these economic times.
  3. He hasn't shown his face in court in almost a year - not only in this case, but in the other one as well. His wife will probably once again try to handle the case - in which case, there's not much of a defense she can make against my claims, since here-say evidence is inadmissable. Bwaaahahaha!!!!!!!!!!!
  4. Since I have the name of the new tenant, and I know they're in an adversarial relationship toward him, I'm going to contact them and let them know that they can sue him for other damages based on the false representations that he certainly made to them ... since he did NOT do the repairs mandated by the city back in May of last year.

He's going to learn that what goes around, comes around.

        Of course, like Novell, it doesn't matter how much I win - I won't be able to collect it because they've already spent it ...

        One thing that only occurred to me this morning is that this case may be setting a record in terms of court dates, hearings, interim judgments, and overall length of time for this particular tribunal. *Nothing* normally takes more than 6 to 9 months even in the busiest of times ... anything over a year raises lots of eyebrows. This dispute is now entering
