The lead plaintiff, Catherine Lewan, was a Kazaa customer who was sued by the RIAA for her use of Kazaa, and paid a settlement to the RIAA, and she sues on behalf of others in her position. In her complaint(pdf) she alleges, among other things, that Kazaa deceptively marketed its product as allowing 'free downloads' (Complaint, par. 30); it designed the software in such a manner as to create a shared files folder and make that folder available to anyone using Kazaa, while at the same time failing to make the user aware that it had done so (Complaint, par. 36-37); and it surreptitiously installed 'spyware' on users' computers which made the shared files folder accessible to the Kazaa network even after the user had removed the Kazaa software from his or her computer (Complaint, par. 42-45)."

emil10001 writes "The National Institute of Standards and Technology (NIST) has rejected a proposal suggesting that electronic voting have a paper trail. The draft recommendation was developed by NIST scientists, who called out electronic voting machines as being 'impossible' to secure." From the article: "Committee member Brit Williams, who opposed the measure, said, 'You are talking about basically a reinstallation of the entire voting system hardware.' The proposal failed to obtain the 8 of 15 votes needed to pass. Five states — Delaware, Georgia, Louisiana, Maryland and South Carolina — use machines without a paper record exclusively. Eleven states and the District either use them in some jurisdictions or allow voters to chose whether to use them or some other voting system." So ... accountability in voting will be a joke for the foreseeable future because it costs too much?

With this new tool, scientists and biologists will be able to make 3D images of cells and tissues for electron tomography, which requires samples less than 300 nanometers thick. And as cells are usually stored in wax for dissection, the researchers plan to test their nanoknives on a block of wax later this year. Where at one time the mighty Soviet space program could count on thousands of applicants offering their services as cosmonauts, today the vast majority of young Russian civilians prefer more lucrative private sector careers, though recruitment among Russian Air Force pilots is still good since the pay is higher in the cosmonaut corps. Russia currently has a total of 37 active cosmonauts in three units, and though these numbers are considered sufficient, there would be fewer available reserves if the ISS crew expands to six, as had been originally intended. 'In the 1960s one would dream of becoming a cosmonaut, now the young men are dreaming of becoming bankers,' says Sergei Shamsutdinov, an editor at the Novosti Kosmonavtiki magazine. 'The romantic aspect of the manned space exploration is no longer there; it has been replaced by gray daily routine.'"

But in many cases you also need to make it easy for your customers to reach you. I have found three common solutions to this problem: 1.) Use an image to replace your email address. 2.) Use ascii encodings for some/all of the characters. 3.) Use javascript to concatenate and/or obfuscate your email address. Which of these methods are most effective? Are email harvesters able to interpret javascript? What do you use?"

Catbeller writes "The AP is reporting that Randy Wooten, mayoral candidate for Waldenburg Arkansas (a town of eighty people) discovered that the electronic voting system hadn't registered the one vote he knew had been cast for him ... because he cast it himself. The Machine gave him zero votes. That would be an error rate of 3%, counting the actual votes cast — 18 and 18 for a total of 36." From the article: "Poinsett County Election Commissioner Junaway Payne said the issue had been discussed but no action taken yet. 'It's our understanding from talking with the secretary of state's office that a court order would have to be obtained in order to open the machine and check the totals,' Payne said. Last night we crossed over 16,777,216 comments in the database. The wise amongst you might note that this number is 2^24, or in MySQLese an unsigned mediumint. Unfortunately, like 5 years ago we changed our primary keys in the comment table to unsigned int (32 bits, or 4.1 billion) but neglected to change the index that handles parents. We're awesome! Fixing is a simple ALTER TABLE statement... but on a table that is 16 million rows long, our system will take 3+ hours to do it, during which time there can be no posting. We heard it is probably due to a resistor controlling 2D/3D switching and that leads to 3D corruption. However, the defect doesn't affect the 8800GTS cards.'"
