But what would actually be said in those situations that would not be illegal discrimination and which there would be no other evidence for?
If they said "sorry we are fully booked" in person they would still have their order book to prove it, right?
What you consider legitimate is not necessarily what someone else considers legitimate. Small business owners have a LOT of leeway in how they schedule their time. A buddy of mine does IT consulting work. He takes time off to drop his daughter off at school. He takes time off to go have coffee with his wife. He takes time to go dirt bike riding with friends. He takes time off because he accumulated 10 errands to run and wants to do them all at once.
This works for him, but how is he supposed to deal with it if somebody gets offended because it's a nice day and he would rather go fishing? To him, it's a perfectly legitimate excuse. He simply doesn't need the work and has other things he would rather be doing with his time.
