New York: Supreme Court (Trial) => Appellate Division (App Div) => Court of Appeals(Highest Court in State). Also you are not entirely correct, in some circumstances, Appellate decisions are binding to ALL lower courts, and in some jurisdictions, they are binding on only those lower courts over which they have direct review. (So the Nassau County Supreme court wouldn't be bound by 1st Department Decisions, but New York County Supreme would. N.b. In New York, this is not the case -- Appellate Decisions from any department are binding provided that the department with direct review does not have conflicting precedent)

IAAL. I am assuming you meant to write "IANAL." A trial court ruling, while not binding on other courts (but certainly persuasive) may in some instances be binding on that same trial court, and as a practical matter, often is even when it need not be. Also, there may be an estoppel issue for the RIAA lurking here.

IAAL. 17 U.S.C. 501(b) authorizes an exclusive licensee to sue for inringement. he has granted an exclusive license. thus he might not want to sue you, but his publisher can. Look through the Silvers v. Sony Pictures case -- unless his contract specifically deals with the right to sue for infringement....his publisher can.

Obama Wants Broadband, Computers Part of Stimulus 901

damn_registrars writes "President-elect Barack Obama announced in his radio address that his administration's economic stimulus package will include investing in computers and broadband for education. 'To help our children compete in a 21st century economy, we need to send them to 21st century schools.' He also said it is 'unacceptable' that the US ranks 15th in broadband adoption." No doubt with free spyware and internet filtering. You know... for the kids.

LucasArts, Bioware Announce Star Wars MMO 346

LucasArts and Bioware held a press conference today to confirm what has been suspected for a long time: they're working on a Star Wars MMO. It will be called Star Wars: The Old Republic, and it will be a continuation of the Knights of the Old Republic franchise. Further coverage is available at Gamespot, and IGN has some of the concept art. An official website for the game was launched as well. "According to the game's official announcement, Star Wars: The Old Republic is set thousands of years before the rise of Darth Vader, with the galaxy divided by war between the Empire and the Sith. That's about 300 years after the events of KotOR, a time frame that, according to Zeschuk, 'is completely unexplored in the lore.' Players can take the role of either a Jedi, a Sith or other classic Star Wars characters -- and, as perhaps can be expected from BioWare, Muzyka says story will be a major component, underlying and driving all of the player's actions."

Only thing that is lackign from microusb; is cuncurrent playback + charging; my Zune (gasp) has the best sound quality of anything I have; but proprietary charger for dock :(
