Non-Copied Photo Is Ruled Copyright Infringement 657

An anonymous reader writes "A UK judge ruled that a photograph inspired by another photograph, but clearly different from it, infringes the original photo's copyright. The two photographs were shot in the same location, have the same subject, and use the same distinctive post-processing treatment. However, the angle and composition are different. From the article: '[The judge] said a difficult decision hinged on a "qualitative assessment of the reproduced elements." He defined Fielder's image a "photographic work," as distinct from a simply a photograph, in that "its appearance is the product of deliberate choices and also deliberate manipulations by the author," and concluded that those aspects had been copied.'"

If you don't want to learn Prawn and are more comfortable with HTML, use something like PDFKit, which is a wrapper around wkhtmltopdf, which basically just packages WebKit for PDF printing. You'll be able to use CSS3 and other niceties and it'll be consistent, since it's creating a pdf. Perhaps you can do better things with Prawn, but I guarantee that writing moderately complex reports will be easier with PDFKit then with Prawn.

Get your facts straight. The legal justification was not written by the Clinton Justice department. Most, if not all, of the legal justification was done by John Yoo (in the Office of Legal Counsel) and David Addington (Cheney's legal counsel, now chief of staff). They were the people who empowered the NSA, the Justice Department and the President to act so egregiously.

Stealing Data With Obfuscated Code 101

Weblver1 writes "A recent report by web security firm Finjan shows how easily data can be accessed on PCs by malware which circumvents existing defenses. With the use of obfuscated code, antivirus software and static Web filters could not identify the scrambled attack code as a threat. The report walks through a real-life scenario of the infection process step-by-step, and tracks what happens to the stolen data. This demonstrates how stealing sensitive data has become unbearably easy — especially, given the abundance of easy-to-use DIY crimeware toolkits. Finjan's report is available here (PDF, registration required). Shortly after this report, Security firm RSA has released their findings of a huge amount of stolen 'virtual wallets' in one of the largest discoveries of stolen data from computers compromised by the Sinowal trojan. While the trojan can be traced back to 2006, it managed to become more productive over time with frequent variants. Given the scale, ease of use, and hiding techniques making infections extremely difficult to find, no wonder today's crimeware achieves such 'impressive' results."

Details are pretty slim on this one at the moment, but PC Perspective is reporting that NVIDIA has snapped up the Utah-based start-up RayScale, a maker of ray tracing software. As PC Perspective points out, the move is made particularly interesting in light of some recent comments made by NVIDIA CTO David Kirk, who mused about the merging of ray tracing and rasterization into a "hybrid renderer" of sorts, but didn't offer any firm details on the company's plans at the time. No word on a price tag for the acquisition just yet, or any other details for that matter, but it seems like things should be getting a bit more official in the next few days.

Comment RTFA! Google Video Will Still Host Content! (Score 5, Informative) 119

Google Video is not going away! All they're doing is adding YouTube results to the search results when you search Google Video. Their plan is to at some point incorporate other video websites so that Google Video is not just a place to view videos, but also the one place to search for videos.
