The Oregon Employment Department agrees with the Union!

My benefits have been allowed because my Asperger's did not allow me to transfer information about one part of the policy being enforced to another part of the policy. Therefore, my discharge was NOT due to willful or wantonly negligent disregard of the employer's interest, and since I had NOT been warned about syncing my outlook calendar to my cell phone, the discharge was NOT for just cause.

In addition to that, it was decided that excessive personal use of the internet and the cell phone incident were two different things- and I deserved progressive discipline on BOTH.

Now all I need to do is bring this letter into the grievance meeting, and point out that I had requested *additional* training as an accommodation for my disability- which puts this squarely *outside of state policy* and into federal Americans With Disabilities Act land.

PLUS I now get unemployment for it!

  • I won't comment on govt. agency incompetence and lack of real accountability, I'll just say congrats and I'm happy for you and relieved, because I think firing someone (i.e. cutting them off from their means of meeting their basic survival needs, like food and shelter) should be a last resort.
    • Something else I found out- despite the big bruhaha they made of watching TV on my cell phone during my lunch, my REAL crime was hooking my phone up to a state computer to copy my schedule to it.

      And that, by the policy and contract, is not a firing offense unless they can prove I was hacking with it. Which they can't- because I wasn't. I should have only gotten a letter of reprimand- at worst.

      Firing ought to be the last resort.

      Three months ago I was fired for disagreeable unacceptable reason. I had no effective way to oppose their decision.
      I was a dispatched worker from another company than the company I was assigned to work. Their excuse was I was not fired from the dispatch company though I was fired from the company I was assigned.

      • That's the problem with consulting- no union. I like my union- they're working hard to get my job back. But I'll return to consulting if I need to. (Dispatch working to you). Here in America, EVERY job is open to dispatch workers- but often times the overhead means that a consultant can cost 1.5-2x what a permanent worker will. However, for some companies, not having to keep that person on for more than 6 months is worth it.

The brain is a wonderful organ; it starts working the moment you get up in the morning, and does not stop until you get to work.
