CWmike writes "Nokia asked a federal judge last week to toss out Apple's antitrust claims, saying the iPhone maker indulged in 'legal alchemy' when it tried to divert attention from its infringement of Nokia's intellectual property. The filing was the latest salvo in a battle that began in October 2009 when handset maker Nokia sued Apple, saying the iPhone infringed on 10 of its patents, and that Apple was trying 'to get a free ride on the back of Nokia's innovation.' Apple countered in December with a lawsuit of its own that not only claimed Nokia infringed 13 of its patents, but that Nokia also violated antitrust law by legally attacking Apple after it declined to pay what it called 'exorbitant royalties' and refused to give Nokia access to iPhone patents. 'These non-patent counterclaims are designed to divert attention away from free-riding off of Nokia's intellectual property, a practice Apple evidently believes should only be of paramount concern when it is the alleged victim,' Nokia charged in the motion. Apple is on a legal roll, having also recently sued the maker of Google's Nexus One, HTC, for patent infringement."

mask.of.sanity writes "BitDefender has released what it claims is the first vaccination tool to remove the notorious Conficker virus that infected some 9 million Windows machines in about three months. The worm, also known as Downadup, exploits a bug in the Windows Server service used by Windows 2000, XP, Vista, Server 2003 and Server 2008. It spreads primarily through a buffer overflow vulnerability in Windows Server Service where it disables the operating system update service, security center, including Windows Defender, and error reporting. The Romanian security vendor said its removal tool will delete all versions of Downadup and will not be detected by the virus."

The Tumeroks blog reports that the University of California, Berkeley is now offering a class on Blizzard's Starcraft real-time strategy game. "This course will go in-depth in the theory of how war is conducted within the confines of the game Starcraft. There will be lecture on various aspects of the game, from the viewpoint of pure theory to the more computational aspects of how exactly battles are conducted. Calculus and Differential Equations are highly recommended for full understanding of the course. Furthermore, the class will take the theoretical into the practical world by analyzing games and replays to reinforce decision-making skills and advanced Starcraft theory."

Photographer Duane Kerzic was standing on the public platform in New York's Penn Station, taking pictures of trains in hopes of winning the annual photo contest that Amtrak had been running since 2003. Amtrak police arrested him for refusing to delete the photos when asked, though they later charged him with trespassing. "Obviously, there is a lack of communication between Amtrak's marketing department, which promotes the annual contest, called Picture Our Trains, and its police department, which has a history of harassing photographers for photographing these same trains. Not much different than the JetBlue incident from earlier this year where JetBlue flight attendants had a woman arrested for refusing to delete a video she filmed in flight while the JetBlue marketing department hosted a contest encouraging passengers to take photos in flight." Kerzic's blog has an account of the arrest on Dec. 21 and the aftermath.

An anonymous reader writes "ZDNet's Adrian Kingsley-Hughes tested the latest Win7 build against XP and Vista and came to a surprising conclusion: Win7 performs better than the other 2 OSs in the vast majority of the 23 tasks tested. Even installation. 'Rather than publish a series of benchmark results for the three operating systems (something which Microsoft frowns upon for beta builds, not to mention the fact that the final numbers only really matter for the release candidate and RTM builds), I've decided to put Windows 7, Vista and XP head-to-head in a series of real-world tests...'" This review shows only a 1-2-3 ranking for each test, so there's no sense of the quantitative level of improvement.

An anonymous readerwrites "On Friday the wonderfully customer centric AirTran decided to remove a family of 9 US born Muslims after a comment between two family members regarding how close to the Jet engine they had been seated. The wonderful part is that after the FBI cleared the family 2 hours later, AirTran refused to fly the family, and refused to rebook them on their way from Washington to Orlando, Florida. The family purchased additional tickets on US Airways later that day, after AirTran requested that the irate father be escorted from their booking podiums by security. This whole story highlights the pathetic customer service we are getting from the Airlines these days — they actually treat us like criminals first and ask questions later. Just don't get me started on Delta." It's nice to see that stupidity still knows no bounds.

But now some commentators claim Microsoft deliberately allowed the package to get into the hands of pirates. 'I'm not being critical here, as some Microsoft Watch commenters will surely claim. It's rather smart marketing. Microsoft fills a big news void with something bloggers and journalists will write about. The suspense of stealth downloads from torrents and races to post the best screenshots first make the Windows 7 leak buzz all the more exciting. For other people, there is delight in seeing Microsoft squirm because Seven leaked early. Not that I see much squirming going on.'"
