Actually, the Librarian of Congress granted 2 exemptions to the anti-circumvention statute in the DMCA, and neither deals with traditional fair use, including time/space shifting, or educational uses. See the documentation here.

The two exemptons are the decryption of lists of blocked URLs that filtering software uses and the access to programs protected by broken or obsolete access control mechanisms (e.g., dongle breaks, company is out of business).

Throw in the potential of the SSSCA and you've got a heck of a dismal future for fair use...
